Mediante este AVISO el Departamento de Agricultura informa al público sobre la propuesta del siguiente:
REGLAMENTO PARA EL PROGRAMA DE CÁÑAMO DEL DEPARTAMENTO DE AGRICULTURA DE PUERTO RICO
El reglamento propuesto se presenta en virtud del “Plan de Reorganización del Departamento de Agricultura de 2010” y la Ley Núm. 38 de 30 de junio de 2017, según enmendada, conocida como “Ley de Procedimiento Administrativo Uniforme del Gobierno de Puerto Rico”, según enmendada.
Este Reglamento estará disponible al público para su revisión, en la Oficina de Asuntos Legales de esta Agencia o a través de nuestra página cibernética www.agricultura.pr/olicpr. Estamos localizados en la Ave. Fernández Juncos Núm. 1309, Parada 19 1/2, San Juan, Puerto Rico. Abierto al público de lunes a viernes de 7:30am a 4:00pm.
Cualquier comentario, recomendación o solicitud de vista oral acompañada de los fundamentos que justifiquen la concesión de la misma, deberá ser remitido por escrito al Secretario de Agricultura dentro de los próximos treinta (30) días, contados a partir de la fecha de la publicación.

NOTA: Este anuncio es requerido por la Ley 38 del 2017, según enmendada, Ley de Procedimiento Administrativo Uniforme del Gobierno de Puerto Rico, en el Articulo #12.001, Sección 2.1, indica la siguiente:
Siempre que la agencia pretenda adoptar, enmendar o derogar una regla o reglamento, publicará un aviso en español y en inglés en no menos de un periódico de circulación general en Puerto Rico, y en español e inglés en la red de internet. Disponiéndose, que si la adopción enmienda, o derogación de la regla o reglamento afecta, a una comunidad de residentes en específicos, la agencia deberá publicar el mismo aviso en un periódico regional que circule en el área donde ubique dicha comunidad, y además deberá pautar un anuncio en una emisora de radio de difusión local de mayor audiencia o mayor cercanía a la comunidad afectada por lo menos en dos (2) ocasiones en cualquier momento en el horario comprendido entre las 7:00 de la mañana y las 7:00 de la noche. El anuncio en la radio deberá indicar la fecha en que se publicó el aviso en el periódico. Tanto el anuncio radial como el aviso contendrán un resumen o explicación breve de los propósitos de la propuesta acción, una cita de la adopción legal que autoriza dicha acción y la forma, el sitio, los días y las horas en que se podrán someter comentarios por escrito o por correo electrónico o solicitar por escrito una vista oral sobre la propuesta acción con los fundamentos que a juicio del solicitante hagan necesaria la concesión de dicha vista oral e indicará el lugar físico y la dirección electrónica donde estará disponible al público, el texto completo de la reglamentación a adoptarse. Al recibir comentarios por correo electrónico, la agencia acusará recibo de los mismos por correo electrónico dentro de dos (2) días laborables de su recibo. El aviso publicado en el periódico contendrá, además, la dirección electrónica de la página donde la agencia haya elegido publicar el aviso en la Red y el texto completo de la regla o reglamento.
Todo aviso sobre propuesta de adopción de reglamentación que se publique o pretenda publicar a tenor con las disposiciones de esta Sección, estará exento de la aplicación de las disposiciones del Artículo 12.001 de la Ley 78-2011, según enmendada, conocida como el “Código Electoral de Puerto Rico para el Siglo XXI”.

REGULATION FOR THE PUERTO RICO DEPARTMENT OF AGRICULTURE HEMP PROGRAM
The proposed regulation is presented under the "Reorganization Plan of the Department of Agriculture of 2010' and Act. No. 38 of June 30, 2017, as amended, known as the "Uniform Administrative Procedures Act of the Government of Puerto Rico".
This Regulation will be available for public review in the Office of Legal Affairs of the Agency or through our web page www.agricultura.pr/olicpr. We are located on No. 1309 Fernandez Juncos Ave., Stop 19 1/2, San Juan, Puerto Rico. Open to the public Monday through Friday from 7:30 am to 4:00 pm.
Any comment, recommendation or request for hearing accompanied by the grounds which justify the granting there of shall be submitted in writing to the Secretary of Agriculture within the next thirty (30) days, counted from the date of publication.

Whenever the agency intends to adopt, amend or repeal a rule or regulation, it will publish a notice in Spanish and English in no less than one newspaper of general circulation in Puerto Rico, and in Spanish and English on the Internet. Provided, that if the adoption, amendment, or repeal of the rule or regulation affects a specific community of residents, the agency must publish the same notice in a regional newspaper that circulates in the area where said community is located, and it must also state An announcement on a local radio station with the highest audience or closest proximity to the affected community at least two (2) occasions at any time between 7:00 a.m. and 7:00 a.m. the night. The radio announcement must indicate the date the announcement was published in the newspaper. Both the radio announcement and the notice will contain a summary or brief explanation of the purposes of the proposed action, a quote from the legal adoption that authorizes said action, and the form, location, days and hours in which comments may be submitted by written or by email or request in writing an oral hearing on the proposed action with the grounds that in the opinion of the applicant make it necessary to grant said oral hearing and will indicate the physical place and the electronic address where the full text will be available to the public of the regulations to be adopted. Upon receiving comments by email, the agency will acknowledge receipt of them by email within two (2) business days of receipt. The notice published in the newspaper will also contain the electronic address of the page where the agency has chosen to publish the notice on the Web and the full text of the rule or regulation.
Any notice regarding the proposed adoption of regulations that is published or intends to be published pursuant to the provisions of this Section, shall be exempt from the application of the provisions of Article 12.001 of Law 78-2011, as amended, known as the “Electoral Code of Puerto Rico for the XXI Century ”.
